King Arthur Sweepstakes Contest Rules

1. Eligibility. No purchase is necessary to enter King Arthur Sweepstakes (the "Contest"). In accordance with these rules (the "Rules"), this Contest is open to all individuals, 21 years of age or older as of the date of entry, who are legal residents of the United States. All employees and consultants of King Arthur Flour, Inc. ("King Arthur Flour") or its subsidiaries, including The Baker's Catalogue; members of their immediate families, or those with whom they are domiciled, are not eligible. In addition, anyone living in a state where the Contest is prohibited, taxed, or otherwise restricted under state and local laws, rules, or regulations is ineligible. King Arthur expressly disclaims any responsibility or liability for any entrant who enters when it is illegal for them to do so. By entering this Contest, entrants agree to waive any additional rights granted in regard to contests by the state in which they are domiciled.

2. How to Enter. Entries may be submitted online at www.kingarthurflour.com/sweepstakes. Also, a completed entry form card may be submitted to our Baker's Store in Norwich, Vermont. Please do not mail entry form card. All entries must be received on or before 11:59 p.m. EST on October 27th, 2008. King Arthur assumes no responsibility for lost, late, or misdirected entries. Proof of transmission of an entry will not constitute proof of receipt of said entry. By providing your e-mail address, you grant King Arthur the right to send you future promotional opportunities including recipes, seasonal product information and special promotions, subject to your right to opt-out of receiving such promotions by notifying us through the method prescribed in any such promotional communication. Limit one entry per person.

3. Winning. All timely entries will be collected, and then the winning entry will be randomly drawn by an officer of King Arthur Flour. The winner will be announced on November 3rd, 2008 and shall be notified that he/she may claim the prize by e-mail, first class mail or phone based on the information provided in the entry form. If the winner does not claim the prize within ten (10) days of the first notification attempt, such person may be disqualified and an alternate will be selected in accordance with these rules. Prior to being declared the winner, the potential winner will be required to sign before a notary and return an Affidavit of Eligibility and Prize Acceptance/Liability and (where legally permissible) a Publicity and Copyright Permission Release Form within ten (10) business days of receipt. Non-compliance may result in disqualification and the Contest prize will be awarded to an alternate Prize Winner in a random drawing from among all remaining entries. The winner shall be required to provide a photocopy of a valid driver's license or other identification before receiving any prize. We may also request confirmation of your social security number, if, in our discretion, it is necessary to report your winnings to the Internal Revenue Service, or applicable state taxing authority. If you are chosen as the winner, King Arthur will coordinate shipping arrangements with you. We will ship to one destination within United States.

4. Prize. The winner will receive a $1,000 King Arthur Flour gift card. Five runners-up will each receive a $100 King Arthur Flour gift card. King Arthur reserves the right to substitute products of equal or greater value. The prize must be claimed by the winner and is not transferable. No cash redemption, good towards Bakers Catalogue products only.

5. Legal Considerations. The odds of winning depend on the number of eligible entries received. Upon shipment to the winner's address, King Arthur will be deemed to have awarded the prize to the winner with the winner assuming full responsibility for the prize. Except for shipping costs, which will be paid by King Arthur, the winner, and not The Baker's Catalogue, is solely responsible for all other arrangements, costs and expenses associated with receiving the prize, including without limitation, any taxes or other fees imposed by a government authority. All entrants agree that submitting the entry form constitutes agreement to the terms and conditions of these Rules. The winner shall be required to sign an additional liability waiver and statement of eligibility before receiving any prize. By submitting an entry form, the entrant is representing and warranting to King Arthur that he/she is an eligible contestant.

6. Indemnification and Disclaimer. Each entrant agrees to indemnify, defend and hold harmless King Arthur and its affiliates, subsidiaries, officers, directors, representatives, agents, and employees from any and all liability whatsoever for any injuries, losses, or damages of any kind arising from or in connection with, either directly or indirectly: (1) the entrants breach of any representation or warranty contained herein, (2) awarding, acceptance, receipt, possession, use, and/or misuse of any prize awarded herein; or (3) participation in the Contest. King Arthur is not responsible for incorrect or inaccurate entry of information including, but not limited to, technical malfunctions, human error, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, entry materials that have been tampered with, or entries that are illegible, late, lost, damaged, or misdirected.

7. Amendments; Termination. King Arthur reserves the right to cancel, terminate, modify, or suspend this Contest for any reason, including but not limited to, fraud, technical failures, or any other causes beyond the control of King Arthur that corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest.

8. Governing Law. This Contest shall be interpreted and governed by the laws of the State of Vermont and any applicable laws and regulations of the United States. The entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively, before a state or federal court located in Windsor County, Vermont having competent jurisdiction, which Court shall apply the laws of the State of Vermont without regard to any principles of conflicts of laws, and submission of said entry constitutes acceptance of such laws. The entrant further agrees that no claims, judgments or awards shall exceed the amount of the Contest prize and under no circumstances shall include attorney's fees; nor shall any entrant be permitted to obtain awards for punitive, incidental, consequential, or other similar damages or have any damage awards multiplied or increased for any reason.

9. General. By entering this Contest, and accepting a prize, entrants: (1) agree to be bound by these rules; (2) agree to release King Arthur and their affiliates from all liability, claims, action or proceedings related to the Contest and from injuries or damages relating to acceptance or use of the prize; and (3) consent to the use of his/her name, voice, picture and likenesses and winning entry for editorial, advertising and promotional purposes in any medium throughout the world in perpetuity without additional compensation unless prohibited by law.
